Terms of Service

These Terms of Service ("Terms") govern your use of Pocket Call Sheet (the "App"), provided by Out of Exile, a California corporation, doing business as Snake Byte Studio ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

Subject to your compliance with these Terms, Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your own personal or internal production use, on devices you own or control, in accordance with the App Store's usage rules.

2. Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App;
• Reverse engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits;
• Rent, lease, lend, sell, redistribute, or sublicense the App;
• Remove or obscure any proprietary notices on the App;
• Use the App for any unlawful purpose or in violation of any applicable law.

3. Your Content

You retain all rights to the production data, call sheets, and other content you create within the App ("Your Content"). You are solely responsible for Your Content, including having the necessary rights and permissions to include the personal information of cast, crew, or other individuals on a call sheet, and for how you distribute Your Content once exported or sent from the App.

4. Intellectual Property

The App, including its design, text, graphics, and underlying code, is owned by Company and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 1, no rights are transferred to you.

5. Purchases

Pocket Call Sheet may be offered as a one-time paid download and/or, where indicated in the App Store listing, as an auto-renewing subscription or in-app purchase. Current pricing and the applicable purchase model are disclosed in the App Store listing and at the point of purchase.

6. Subscriptions (If Applicable)

If you purchase a subscription:

• Billing and auto-renewal. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Managing and cancelling. You can manage or cancel your subscription at any time in your device's App Store account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for the remainder of a billing period.
• Free trials. If a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial period, and payment will be charged at the end of the trial unless cancelled beforehand.
• Price changes. We may change subscription pricing from time to time. Any price change will be communicated in advance as required by the App Store and will apply to subsequent billing periods.

All billing is handled by Apple (or the applicable app marketplace) as your merchant of record; refund requests should generally be directed to Apple in accordance with their refund policies.

7. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY CALL SHEET GENERATED WILL BE FREE OF ERRORS. YOU ARE RESPONSIBLE FOR REVIEWING ANY CALL SHEET FOR ACCURACY BEFORE DISTRIBUTING IT TO YOUR PRODUCTION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Termination

We may suspend or terminate your license to use the App if you violate these Terms. You may stop using the App and delete it from your device at any time.

10. Apple as Third-Party Beneficiary

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Company only, not with Apple, and Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce them against you.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and post the revised Terms at this page. Continued use of the App after revised Terms are posted constitutes your acceptance of the changes.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Company regarding the App and supersede any prior agreements.
